Modern Slavery Report

This report (the “Report”), prepared in accordance with the Malaysia Employment Act 1955, pertains to PA Food (“we,” “our,” “us”). The Report outlines the steps taken during our operation to prevent and mitigate the risk of forced labor or child labor within any stage of our procurement and production processes, both within Malaysia and in our international supply chains.

The Report covers our relevant Malaysian operations and details the measures we are implementing to ensure that modern slavery does not occur in our operations or supply chains.

At PA Food, we are dedicated to ensuring that every individual within our direct operations and supply chains is treated equitably and receives fair compensation for their labor. We consider child and forced labor to be entirely unacceptable in our operations.

Our commitment extends to respecting and upholding the human rights of all individuals who interact with our business, including our employees, temporary workers, supply chain personnel, and local communities.

We work proactively with our suppliers to achieve optimal outcomes for workers throughout our value chain. Our vision is to share the foods Malaysians love with the world, while our mission is to innovate Asian-inspired cuisine with care and passion, creating products that are better for you and resonate deeply with the heart.

Organizational Structure

For our entire business operation since year 1985 history, we have operated as an independent family business. Family values of care and consideration combined with our ethos of sharing and openness have fostered a passionate and good-natured working environment.

As our business grows, we have been able to bring on board more incredible people from Malaysia’s diverse, multicultural population and led by Managing Director Mr Ding Hong Sing, supported by senior executives who oversee each functional department. And it’s those staff members that maintain our legacy of quality and care and share our passion for bringing you unforgettable Malaysian flavours.

PA Food operates with a unified purpose and a core set of guiding principles. At PA Food, we adhere to unwavering ethical standards, striving to build a resilient and sustainable business where everyone finds joy and fulfilment in their work.

Activities and Supply Chain

Raw materials are procured in accordance with our internal supply policies and in collaboration with our supplier partners, utilizing a blend of local and internationally established sources.

In our operations, we employ automation and semi automation in different production line. Our products are then processed, packaged, and transported to retailers’ distribution centers via third-party logistics providers before reaching the stores. We ensure proper internal and external storage for both raw materials and finished products.

We collaborate with suppliers who align with our dedication to quality, food safety, employee welfare, and sustainability. We are committed to maintaining the integrity and traceability of the raw materials used in our products, including vegetables, meat, ingredients, and packaging. We have established specific supplier standards for each category of raw material, outlining the expectations we require our suppliers to meet.

We are aware of our responsibility towards workers throughout our value chain and aim to work in partnership with our suppliers to identify and address potential risks related to modern slavery.

Policies

Code of Conduct

PA Food is dedicated to conducting its operations with the utmost ethical standards and adherence to all relevant laws, regulations, and rules. We place a high value on the integrity of every employee and representative of the Company.

We expect not only compliance with all applicable legal requirements but also adherence to responsible and ethical conduct as outlined in our Code of Business Conduct and Ethics (the “Code”) and the related policies detailed in the Company’s Policy Manual.

Recruitment Policy

PA Food upholds equal opportunity and fair hiring practices in all recruitment efforts, focusing on selecting the most qualified individuals based on their knowledge, skills, abilities, and other relevant competencies. We have implemented this policy to ensure that all employees and prospective candidates are evaluated through a consistent, fair, and equitable process. To maintain a safe work environment for all employees, PA Food will not employ individuals under the age of 18.

Respectful Workplace

PA Food has a zero-tolerance policy for bullying, harassment, or any inappropriate behavior that could reasonably cause humiliation, intimidation, or embarrassment. Mutual respect is a fundamental value and expectation for everyone at PA Food, regardless of their position. We encourage thoughtful communication and behavior, ensuring that our actions do not intimidate, embarrass, offend, or otherwise discomfort others.

The purpose of the policy are to:

  • Establish standards for behavior and conduct to promote a respectful workplace, free from bullying, discrimination, and harassment.
  • Promote the prompt resolution of disrespectful behavior through collaborative dialogue.
  • Establish guidelines for formal resolution processes to address bullying, harassment, discrimination, and other forms of disrespectful conduct.

Policy on Forced and Child Labor

PA Food upholds a strict zero-tolerance policy against forced and child labor, regardless of our business partners or operational locations. We are dedicated to complying with all applicable laws related to forced and child labor in every country where we operate and to ensuring these practices are not present within our supply chain.

We expect our suppliers to implement comprehensive measures to prevent and address forced and child labor within their own supply chains. If credible concerns are raised in good faith or if forced or child labor is identified in the supply chains of existing or potential suppliers, we will undertake a thorough review of our relationship with those suppliers.

Such findings may affect our business relationships and could result in actions including the suspension or termination of partnerships, as deemed appropriate.

Determining and Risk of Force and Child Labor

Internal

We assess the risk of forced or child labor within our workforce as minimal. Our Managing Director, in conjunction with the Executive Leadership Team, supervises the implementation of our human resource policies. Our recruitment processes adhere to the prevailing standards in Malaysia, where the majority of our staff are based. Additionally, we respect and uphold our employees’ right to freedom of association.

Within Our Supply Chain

We acknowledge the potential risk of forced labor throughout our supply chain. Currently, we have established processes to evaluate this risk with our first-level suppliers.

In our industry, we assess the risk of forced labor or child labor with our direct suppliers as minimal. However, for certain materials, where specific geographic regions or materials are flagged by relevant authorities, the risk may increase for suppliers further down the supply chain. Identifying and addressing this risk for indirect suppliers, over whom we have limited control and visibility, can be challenging. We are committed to making reasonable efforts to understand and manage these risks.

Steps Taken to Access and Manage Risks in Our Operations and Supply Chain

The supply of goods and services is guided by specific operating philosophies and principles that align with our strategic objectives and growth plans. All participants in our supply chain play a crucial role in this process.

We depend on the collaboration of our suppliers and expect them to uphold the highest standards of quality and ethics, as outlined in our policies and codes of conduct, which are detailed further in this report.

We rely on close collaboration among key supply stakeholders to ensure compliance and mitigate risks:

  • Our Corporate QA and Regulatory Department supports strategic sourcing with a focus on food safety, environmental, social, and governance strategies. It ensures that sourcing meets BRC standards and engages with stakeholders in assessing needs and selecting goods or services.
  • The Procurement Department works closely with the QA and Regulatory Department, which contributes to contract negotiations and provides recommendations and opinions.
  • We have communicated our policies and expectations to our vendors and suppliers and conducted thorough risk assessments of our primary suppliers and partners to evaluate their compliance. This assessment incorporates guidance from the Malaysia Department of Labor on geographic and material-specific risks. For identified higher risks, we have made reasonable efforts to obtain their statements and policies on forced labor and child labor.
  • This risk assessment model is integrated into our existing supplier and vendor approval program to ensure that these critical issues are addressed during the evaluation of new suppliers.
  • We work with Intertek , which provides annual compliance audits to BRC (British Retail Consortium) standards regarding our supply chains, food safety, quality standards, and vendor management and approval.
  • We are certified by RSPO (Roundtable on Sustainable Palm Oil), which ensures that our oil suppliers uphold workers’ rights (and their families) in accordance with international and local standards. This certification also helps minimize environmental impact through responsible land management, reduced chemical use, and the protection of high conservation value areas.

Remediation Measures 

In the past year, we did not detect any instances of forced labor or child labor within our operations or supply chain. Consequently, no remediation actions were necessary. If such incidents are identified in the future, we will adopt suitable remediation strategies in line with international standards.

Training

As part of our efforts to engage stakeholders on key business priorities such as health and safety, food safety, and social issues, we encourage employees to serve as ambassadors for these initiatives. To support this, we have created a comprehensive internal training document and package.

All employees have received training on our policy and company expectations. Each employee has signed to acknowledge their understanding and commitment to comply with our policy.

Our policy and expectations have also been communicated through company notice boards, which serve as our standard method for disseminating important policies and ensuring ongoing access for all employees.

Assessment of Efficiency 

Over the past financial year, we have implemented various measures to mitigate the risk of forced labor and child labor within our operations and supply chains. However, we have not yet evaluated the effectiveness of these measures.

Continuous Improvement and Prospective Interventions 

Although we are proud of our achievements and confident in our effective management of risks, we recognize that this is an ongoing journey. We are committed to continuously improving our practices.

Approval and Attestation 

This report was approved by the Managing Director of PA Food for August, 2024, in accordance with the Employment Act 1955.

In compliance with the requirements of the Employment Act 1955, I confirm that I have reviewed the information contained in this report for the aforementioned entity. To the best of my knowledge, and after exercising due diligence, I certify that the information in this report is true, accurate, and complete in all material aspects for the purposes of the Acts, for the reporting year indicated above.
